These terms apply to your use of koohculture.com and to anything you buy from us. By using the site or placing an order, you agree to them. If you do not agree, please do not use the site.

In these terms, "we", "us" and "our" mean Kooh Culture. "You" means you, the person using the site.

Using The Site

You must be at least 13 years old to use this site. If you are under 18, you may only use it with the involvement of a parent or guardian.

You agree not to use the site for anything unlawful, not to attempt to gain unauthorised access to it, and not to copy, scrape or resell any part of it without our permission.

We may change, suspend or withdraw any part of the site at any time.

Products And Pricing

We try to show our products accurately, but colours can look different from screen to screen, and the item you receive may vary slightly from the photograph. Our hats and apparel are made in small batches, so there can be minor variation between pieces.

All prices are in US dollars and do not include shipping or applicable taxes, which are added at checkout.

We may change prices at any time without notice. The price that applies to your order is the one shown at the time you place it.

Products are subject to availability. Occasionally an item shows as available but is not. If that happens we will contact you and refund you in full.

Orders

When you place an order you are making an offer to buy. We accept that offer when we send you a confirmation email.

We may refuse or cancel any order, including where an item is out of stock, where there has been a pricing or description error, or where we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

You are responsible for giving us a correct shipping address. We cannot take responsibility for orders delivered to an address entered incorrectly.

Shipping

We currently ship within the United States only.

Delivery times given at checkout are estimates. Once an order is with the carrier, delivery is outside our control.

Risk of loss passes to you when the carrier takes possession of the order.

Returns

Our returns terms are set out in our Refund Policy, which forms part of these terms.

Intellectual Property

The Kooh Culture name, logo, and all artwork, patch designs, graphics, photographs and text on this site belong to us and are protected by copyright and trademark law.

You may not reproduce, distribute or use any of it commercially without our written permission. Buying a product does not give you any rights in the designs on it.

Your Content

If you send us photographs, reviews, comments or other material, or tag us on social media, you give us permission to use that material to promote Kooh Culture, including on our website and social channels, with credit where practical. You confirm that the material is yours to share and does not infringe anyone else's rights.

Limitation Of Liability

We provide the site and our products as they are. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the site or our products.

Nothing in these terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or your statutory rights as a consumer.

Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the order in question.

Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in California, and you agree to that jurisdiction.

Changes

We may update these terms. The version in force is the one published on this page at the time you place your order. The date at the top shows when it was last changed.
